Licence

Commercial Licence.

Permission to sell what you make with LushClayCo designs. It sits on top of the Personal Use Licence and governs selling where the two differ.

Commercial Licence · Version 1.0 · 22 October 2026

These are the terms you accept when you take out a LushClayCo Commercial Licence. They sit on top of the Personal Use Licence, which still applies to every file you hold. Where the two differ, this one governs selling and that one governs everything else. If you do not accept these terms, do not take out the licence.

1. What you are getting

Permission to sell what you make. Not permission to sell what I made.

The licence is personal, non-exclusive and non-transferable. “You” means one person and the one business that person runs. It is not a studio with several makers, a team, a classroom, a makerspace or a shared account, and it does not pass to anyone else, including with the sale of a business.

You must be old enough to enter a contract where you live.

2. You can

  • Sell the finished pieces you make with LushClayCo cutters, rollers and files. Earrings, pendants, magnets, whatever you make with them.
  • Sell them anywhere you like. Markets, craft fairs, your own shop, Etsy, wholesale to a stockist.
  • Take commissions and custom orders for pieces made with them.
  • Photograph your finished work and use those photos however you want, including in paid advertising.
  • Keep selling the pieces you already made if you later let the licence go. See section 4.
  • Say you used LushClayCo cutters. You are never required to credit me, but I will always see it if you tag me.

3. You cannot

The first one on this list is absolute and there is no tier, no price and no arrangement that changes it.

  • Sell the cutter itself. Not the physical cutter, not the file, not a print of it, not a copy, not a version you rescaled or tidied up. Paid or free, one or a hundred, to a friend or to a shop. This licence lets you sell what the cutter makes. It never lets you sell the cutter.
  • Print cutters for other people. Whether you charge for them or not. Send them to lushclayco.com.
  • Share the file. Not with a friend, not in a group, not in a shared folder, not with a print service that keeps a copy.
  • Give the file away as a freebie, a lead magnet, a destash or a bonus with something else.
  • Upload it anywhere. Not to MakerWorld, Printables, Thingiverse, Cults, a Discord, a Drive folder or anywhere else.
  • Remix, redraw or trace the design, or make your own cutter from it, and then sell that. A design you arrived at by starting from mine is still mine.
  • Sub-licence it, rent it or lend it. Your licence covers you.
  • Use the files to train a model or feed them to any generative system.
  • Use my name, logo or product photography as if you were LushClayCo, a stockist or an official partner.
  • Use any of it unlawfully, or for anything hateful.

4. The licence has to be active at the time of the sale

Active means exactly that. Paid up and running on the day the sale happens.

If you cancel it, or it lapses because a payment fails, your permission to sell ends on the same date. From that date you stop listing, stop selling and stop taking orders for anything made with these designs, and you take down the listings that are still up.

Pieces you already sold while the licence was active stay sold. Nothing is owed on them and nobody is coming after them. Stock you made and have not sold is yours to keep, you just cannot sell it until the licence is active again.

There is no grace period. Start the licence again whenever you want and you can carry on.

5. This does not cover LushKesim

LushClayCo sells cutters, rollers and files. LushKesim is the app, and it is a separate division with its own tiers and its own terms.

This licence covers LushClayCo designs only, from lushclayco.com and from my MakerWorld profile. It does nothing inside the app. Selling cutters you drew yourself in LushKesim needs an Usta licence, which is a different thing bought separately, and an Usta licence does nothing for LushClayCo designs either. If you work with both, you need both.

6. The design stays with LushClayCo

Every right in the designs and the files stays with me, including the ones not listed here. Paying for this licence buys the permission described on this page and nothing else.

What you make is your own work. You price it, you sell it, you stand behind it, and I have no claim on it and take no cut.

7. Sold as is

The files and the cutters are supplied as they are, with no warranty of any kind. Results vary with your printer, your settings, your clay and your hands.

I am not liable for failed prints, wasted material, damaged machines, injury, lost sales, a market that did not go your way, or anything you make and sell. You are selling to your own customers under your own name, so their returns, their complaints and their consumer rights are yours to handle.

8. Selling safely

Cutters have thin edges. Keep them away from small children, and do not use them on food. Printed plastic is not food safe and is not made to be.

If you sell what you make, the rules where you sell are yours to meet. Labelling, small parts, children’s products, nickel content in findings, tax. I cannot advise you on any of it.

9. No refunds

No refunds, on any part of this. The licence is a permission that runs from the moment it starts, and a permission cannot be handed back unused.

Cancel whenever you like and it stops at the end of the period you have paid for. The part you already paid for is not returned, in whole or in part, and that applies to monthly and annual alike.

If a file will not open or is faulty, email me and I will fix the file.

10. If these terms are broken

The licence ends immediately, with no notice and no refund, and you stop selling from that date.

You delete your copies of the files, take down the listings and stop printing. If something you did under this licence lands me with a claim, you cover what it costs me, legal fees included.

11. Changes

These terms may change. Every version is numbered and dated, and the one you accepted is the one that governs your licence until you accept another.

If I change something material you will be asked to accept the new version, and you can cancel instead if you would rather not.

12. Your acceptance is recorded

When you accept these terms I record the version, the date and time, the account and the IP address. You can see your own record any time under Licences in your account.

13. The rest of it

If I do not enforce part of this straight away, that does not mean I have given it up. If any part turns out to be unenforceable, the rest still stands. I may transfer this agreement if the business ever changes hands; you may not. This page, in the version you accepted, together with the Personal Use Licence, is the whole agreement between us about selling.

14. Law

This licence is governed by the laws of the State of Missouri, in the United States.

15. Questions

Email me before you do the thing, not after. I am one person and I would rather sort something out than have anyone guessing.
